These Terms and Conditions govern your use of A1S Contracting's website and services. By accessing our website or engaging our construction and renovation services, you agree to be bound by these terms. If you do not agree, please refrain from using our site or services.
1. Services
A1S Contracting provides construction, renovation, and remodeling services in New York City and surrounding areas. All services are subject to the terms of the specific contract or work agreement entered into between A1S Contracting and the client.
We reserve the right to refuse service to anyone for any reason at any time. We may modify or discontinue any service without notice.
2. Estimates and Contracts
- All project estimates are free and non-binding unless converted into a signed contract.
- Estimates are valid for 30 days from the date of issue, after which pricing may change.
- A signed contract is required before any work begins. The contract will specify scope, timeline, pricing, and payment terms.
- Any changes to the agreed scope of work must be documented in a written change order signed by both parties.
- A1S Contracting reserves the right to adjust pricing if site conditions differ materially from those described at the time of estimate.
3. Payment Terms
- Payment schedules are outlined in the project contract. Typical arrangements include a deposit, progress payments, and a final payment upon completion.
- Deposits are generally due before work begins and are non-refundable once materials have been ordered or work has commenced.
- Final payment is due upon satisfactory completion of the project as defined in the contract.
- Late payments may incur a late fee of 1.5% per month on overdue balances.
- A1S Contracting reserves the right to halt work if payments are not made in accordance with the agreed schedule.
4. Licensing and Insurance
A1S Contracting holds all required New York State contractor licenses and maintains general liability and workers' compensation insurance. Certificates of insurance are available upon request. All work is performed in compliance with applicable New York City and state building codes and regulations.
5. Permits
When required, A1S Contracting will obtain necessary building permits. Permit fees are the responsibility of the client and will be included in the project estimate. The client must provide property access as required for permit inspections.
6. Warranty
A1S Contracting provides a one-year workmanship warranty on all labor from the date of project completion. This warranty covers defects in workmanship but does not cover:
- Damage caused by the client or third parties after project completion
- Normal wear and tear
- Acts of nature or force majeure events
- Manufacturer defects in materials (covered by manufacturer warranties)
Manufacturer warranties on materials and products are passed through to the client and vary by product.
7. Client Responsibilities
The client agrees to:
- Provide safe and reasonable access to the work site at agreed-upon times
- Remove or protect personal property and valuables before work begins
- Ensure that utilities (water, electricity) are available as needed for the project
- Make timely decisions regarding materials, colors, and design choices to avoid project delays
- Make payments according to the agreed schedule
8. Limitation of Liability
To the fullest extent permitted by law, A1S Contracting's total liability arising from or related to any project or service shall not exceed the total amount paid by the client for that specific project. We are not liable for indirect, incidental, consequential, special, or punitive damages. This limitation applies regardless of the form of action or the basis of the claim.
9. Dispute Resolution
In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in New York County, New York, in accordance with the rules of the American Arbitration Association. New York State law governs these Terms.
10. Website Use
The content on our website is provided for general information only. By accessing our website, you agree not to:
- Use the site for any unlawful purpose
- Attempt to gain unauthorized access to any part of the site
- Reproduce, duplicate, or copy any content without our written permission
- Transmit any unsolicited commercial communications
11. Changes to Terms
We reserve the right to modify these Terms at any time. Updated terms will be posted on this page with an updated date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
